Council Tenants Factsheet: flexible fixed term tenancies

Tamworth Borough Council offers Flexible Fixed Term Tenancies to provide stability while making sure homes meet tenants’ changing needs. Here’s a simple guide to help you understand how these tenancies work.

Tenancy Length

  • 5-Year Tenancy: Usually offered for family homes and adapted properties. Generally renewed unless circumstances change.
  • 2-Year Tenancy: Used for properties planned for refurbishment or demolishment.

Review Process

  • Starts 12 months before tenancy ends.
  • You’ll receive a letter explaining the review and what’s needed.
  • Includes a home visit to check if your current home still suits your needs.
  • A decision is made to renew, offer alternative housing, or end the tenancy. 

Ending the Tenancy

  • You can end your tenancy early by giving 4 weeks’ written notice.
  • Property must be inspected and cleared of rent arrears.
  • All keys must be returned on time. 

Demotion

  • If tenancy terms are broken, the Council may apply to demote your tenancy.
  • After the demotion period, tenancy may revert to a fixed term.

Renewal Criteria
Your tenancy may not be renewed if:

  • The property is under-occupied.
  • No one in the household needs the adaptations.
  • You don’t engage with the review process.
  • You own another home.
  • The property is needed for redevelopment. 

Exceptions
In exceptional cases:

  • The Council may renew a tenancy even if criteria aren’t met.
  • Decisions are made by senior housing staff based on evidence and value for money. 

Appeals

  • You can appeal decisions about tenancy length or non-renewal.
  • Appeals must be made within 21 days of receiving the decision letter.
  • If you are not happy with the decision you can appeal by contacting the team, Estate Management team
